    Conditions of Sale

    The following Conditions of Sale are the Luminary's, Sotheby's, Inc.'s ("Sotheby's") and Traina Interactive, Corp.'s ("IfOnly") entire agreement with the Purchaser and any bidders ("you" or "your") relative to the Experiences listed in this e-catalogue and the related auction.

    The Conditions of Sale, the glossary, if any, and all other contents of this e-catalogue are subject to amendment by Sotheby's by the posting of such amendments on the Sotheby's website ( and the Invaluable website ( (collectively, the "Websites").

    By participating in the auction, you acknowledge that you are bound by these Conditions of Sale.

    1. Defined Terms
    "Content" means any information or images included in the e-catalogue or otherwise on any Website related to the Experiences or the auction; "Experience" means each in-person experience listed in this e-catalogue and offered for sale by Luminary on any Website; "Experience Listing" means, for each Experience, the e-catalogue description for such Experience; "Luminary" means, for each Experience, the seller of such Experience; and "Purchaser" means the successful bidder at auction.

    2. As Is
    Each Experience is sold "AS IS" without any representations or warranties of any kind. Without limiting the generality of the foregoing, each of Sotheby's and IfOnly expressly disclaims any implied representations or warranties of merchantability or fitness for a particular purpose, representations and warranties as to the condition, size, quality, rarity, importance, provenance, literature or historical relevance of an Experience, or as to the quality, accuracy, timeliness, non-infringing nature, completeness or reliability of any Content, including any Experience Listing or other description of any Experience and any representations or warranties arising out of course of dealing or usage of trade. No statement anywhere, whether oral or written, whether made in the e-catalogue, an advertisement, or elsewhere, shall be deemed such a warranty, representation or assumption of liability. Neither Sotheby's nor IfOnly makes any representations and warranties, express or implied, as to whether you acquire any intellectual property rights, including but not limited to, any reproduction rights in any Content. Neither Sotheby's nor IfOnly is responsible for errors and omissions in any Content, glossary, or any supplemental material.

    3. No Endorsement
    Neither Sotheby's nor IfOnly plans, hosts, operates, or fulfills the Experiences. Neither Sotheby's nor IfOnly endorses, verifies, vouches for, investigates or vets any Luminary or Experience. Neither Sotheby's nor IfOnly makes any representations or warranties, express or implied, of any kind with respect to any Luminary. Neither Sotheby's nor IfOnly is responsible for estimates, descriptions or any other matters relating to the offer and sale of any Experiences. Information about Experiences is provided by the Luminaries. Neither Sotheby's nor IfOnly verifies the accuracy of this information.

    4. Buyer's Premium
    A buyer's premium will be added to the hammer price and is payable by the Purchaser as part of the total purchase price. The buyer's premium is 25% of the hammer price up to and including $250,000, 20% of any amount in excess of $250,000 up to and including $3,000,000, and 12.5% of any amount in excess of $3,000,000.

    5. Costs and Expenses
    For each Experience, any incidental costs and expenses such as fees for telephony or Internet connectivity, travel, food or lodging are the sole responsibility of the Purchaser unless otherwise expressly stated in the Experience Listing for the applicable Experience.

    6. Withdrawal
    Sotheby's reserves the right to withdraw any experience before, during and after the auction and shall have no liability whatsoever for such withdrawal.

    7. Per Lot
    Unless otherwise stated, all bids are per lot as numbered in the e-catalogue.

    8. Eligibility; Registration
    You may only participate in the auction if you are twenty-one (21) years of age or older and are not barred from participation under applicable law. Purchaser may be required to present satisfactory legal documentation that Purchaser is at least twenty (21) years of age.
    In order to bid, you must first register on the Sotheby's website or the Invaluable website. Sotheby's reserves the right, in its sole discretion, to refuse your registration or participation in the auction or to revoke your permission to participate before, during or after the sale. Bidders should also consult the Sotheby's Website or the Invaluable website for the most up to date cataloguing of the Experiences in this e-catalogue. Bidders are responsible for making themselves aware of all available notices, which will be posted online.

    9. Bidding
    As soon as you place and confirm your bid amount, your bid is submitted. You accept and agree that bids submitted by you are final. Neither Sotheby's, nor IfOnly nor the Luminary is responsible for any errors in bidding. Sotheby's reserves the right to reject any bid. The highest bidder acknowledged by the Sotheby's and Invaluable online bidding systems will be the Purchaser. Sotheby's has absolute and sole discretion in the case of error or dispute with respect to bidding, and whether during or after the sale, to determine the successful bidder, to re-open the bidding, to cancel the sale or to re-offer and re-sell the item in dispute. If any dispute arises after the sale, Sotheby's sale record is conclusive.
    By participating in the sale, you represent and warrant that any bids placed by you, or on your behalf, are not the product of any collusive or other anti-competitive agreement and are otherwise consistent with federal and state antitrust law.

    10. Closing Bidding
    Bids may be submitted from the start of the auction until bidding on the specific lot closes. An end time will be displayed for each lot on the lot detail page. Lots will close in one (1) minute increments unless a bid is placed within five (5) minutes of a lot's scheduled end time, in which case Sotheby's will extend the sale of that lot by five (5) minutes from the time of the last bid. The extension of any one lot's closing time does not affect any other lot's closing time; therefore, it is possible that lots will close out of numerical lot order.

    11. Bids Below Reserve
    If you place a bid below the reserve of the article offered, you will be informed by a message on the screen that the reserve is not met. You will then be able to place a higher bid if you wish to do so. No bidder can successfully win the lot below the reserve.

    12. Record of Sale
    The record of sale kept by Sotheby's will be taken as absolute and final in all disputes. In the event of a discrepancy between any online records or messages provided to you and the record of sale kept by Sotheby's, the record of sale will govern.
    Successful bidders will be notified and invoiced by Sotheby's after the sale. In the event of any discrepancy between any online purchase information and the invoice sent to you by Sotheby's following the sale, the invoice prevails.

    13. Purchaser's Responsibility
    Subject to fulfillment of all of the conditions applicable to Purchaser set forth herein, at the close of a lot, the contract between the Luminary and the Purchaser is concluded, and the winning bidder thereupon will immediately pay the full purchase price or such part as Sotheby's may require. Purchaser will not be able to schedule or participate in any Experience until Sotheby's has received the full purchase price in cleared funds. The Purchaser's obligation to immediately pay the full purchase price or such part as Sotheby's may require is absolute and unconditional and is not subject to any defenses, setoffs or counterclaims of any kind whatsoever. In addition to other remedies available to Sotheby's by law, Sotheby's reserves the right to impose from the date of sale a late charge of the annual percentage rate of Prime + 6% of the hammer price plus buyer's premium if payment is not made in accordance with the conditions set forth herein. Please note Sotheby's reserves the right to refuse to accept payment from a source other than the Purchaser of record.
    If any applicable conditions herein are not complied with by the Purchaser, the Purchaser will be in default and in addition to any and all other remedies available to Sotheby's and the Luminary by law, including, without limitation, the right to hold the Purchaser liable for the total purchase price, including all fees, charges and expenses more fully set forth herein, Sotheby's, at Sotheby's option, may (x) cancel the sale of that, or any other lot or lots sold to the defaulting Purchaser at the same or any other auction, retaining as liquidated damages all payments made by the Purchaser, or (y) resell the purchased Experience, whether at public auction or by private sale, or (z) effect any combination thereof. In any case, the Purchaser will be liable for any deficiency, any and all costs, handling charges, late charges, expenses of both sales, Sotheby's commissions on both sales at Sotheby's regular rates, legal fees and expenses, collection fees and incidental damages. Sotheby's may, in Sotheby's sole discretion, apply any proceeds of sale then due or thereafter becoming due to the Purchaser from Sotheby's or any affiliated company, or any payment made by the Purchaser to Sotheby's or any affiliated company, whether or not intended to reduce the Purchaser's obligations with respect to the unpaid lot or lots, to the deficiency and any other amounts due to Sotheby's or any affiliated companies. In addition, a defaulting Purchaser will be deemed to have granted and assigned to Sotheby's and Sotheby's affiliated companies, a continuing security interest of first priority in any property or money of or owing to such Purchaser in Sotheby's possession, custody or control or in the possession, custody or control of any of Sotheby's affiliated companies, in each case whether at the time of the auction, the default or if acquired at any time thereafter, and Sotheby's may retain and apply such property or money as collateral security for the obligations due to Sotheby's or to any affiliated company of Sotheby's. Sotheby's shall have all of the rights accorded a secured party under the New York Uniform Commercial Code. You hereby agree that Sotheby's may file financing statements under the New York Uniform Commercial Code without your signature. Payment will not be deemed to have been made in full until Sotheby's has collected good funds. Unless otherwise directed by Sotheby's, any claims relating to any purchase, including any claims under the Conditions of Sale, must be presented directly to Sotheby's. In the event the Purchaser fails to pay any or all of the total purchase price for any lot and Sotheby's nonetheless elects to advance by or on behalf of the Luminary any portion of the sale proceeds, the Purchaser acknowledges that Sotheby's shall have all of the rights of the Luminary to pursue the Purchaser for any amounts paid to or on behalf of the Luminary, whether at law, in equity, or under these Conditions of Sale.

    14. Reserve
    Unless otherwise indicated, all lots in this e-catalogue are offered subject to a reserve, which is the confidential minimum hammer price at which a lot will be sold. No reserve will exceed the low presale estimate stated in the e-catalogue, or as amended by notices posted on the Sotheby's and Invaluable websites. If you place a maximum bid that equals or exceeds the reserve on a lot for which the reserve has not already been met, the system will automatically raise the current bid to meet the reserve price.

    15. Tax
    Unless exempted by law, the Purchaser will be required to pay state and local sales tax, if applicable, based on the location where the Experience will be fulfilled in states where Sotheby's is registered to collect sales/use tax, and any applicable federal luxury or other tax, on the hammer price plus buyer's premium. Currently, the rate of such combined tax is 8.875% in New York City and ranges from 7% to 8.625% elsewhere in New York.

    16. Charity
    For each Experience that provides in its Experience Listing that a portion of the proceeds will benefit a named non-profit organization ("Charity"), a portion of the total purchase price actually received for the Experience will be paid to the Charity by or on behalf of Luminary. IfOnly and Luminary, not Sotheby's, shall be responsible for ensuring that the applicable proceeds are paid to the Charity. No portion of the purchase price is tax-deductible to Purchaser as a charitable contribution. The Charities listed were selected by the applicable Luminary and Sotheby's neither owns nor operates any such Charity.

    17. Export and Permits
    It is the Purchaser's sole responsibility to identify and obtain any necessary export, import, firearm, endangered species or other permit for the lot. Any notices in the sale e-catalogue reflect Sotheby's reasonable opinion at the time of cataloguing and are for bidders' general guidance only; Sotheby's, IfOnly and the Luminary make no representations or warranties as to whether any lot is or is not subject to export or import restrictions or any embargoes.

    18. Governing Law and Jurisdiction
    These Conditions of Sale, as well as bidders', the Purchasers', Sotheby's, IfOnly's and Luminaries' respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of New York. By bidding at an auction, all bidders including the Purchaser, shall be deemed to have consented to the exclusive jurisdiction of the state courts of, and the federal courts sitting in, the State of New York. All parties agree, however, that Sotheby's shall retain the right to bring proceedings in a court other than the state and federal courts sitting in the State of New York. If a court of competent jurisdiction finds any provision of these Conditions of Sale invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Conditions of Sale will remain in full force and effect.

    19. Limitation of Liability
    In no event will Sotheby's and IfOnly's aggregate total liability to a Purchaser exceed the purchase price actually paid. Sotheby's will not be responsible for any errors or failures to execute bids placed online or for any errors or omissions in connection therewith including, without limitation, errors or failures caused by (i) a loss of connection to the internet or the Sotheby's or Invaluable's Online Platform software by either Sotheby's or the client; (ii) a breakdown or problem with Sotheby's or Invaluable's Online Platform software; or (iii) a breakdown or problem with a client's internet connection, mobile network or computer. Purchaser acknowledges and agrees that, as between Purchaser and IfOnly and as between Purchaser and Sotheby's, in each case to the maximum extent permitted by law, Purchaser assumes the entire risk arising out of or in connection with Purchaser's purchase of and participation in an Experience or otherwise arising out of or in connection with the fulfillment of a purchased Experience. None of IfOnly, its affiliates, employees, shareholders, officers or directors (each, an "IfOnly Party") and none of Sotheby's, its affiliates, employees, shareholders, officers or directors (each, a "Sotheby's Party") (a) are liable for any negligence or willful act or omission of any person or entity providing any goods or services arising out of or in connection with Purchaser's purchase of or participation in any Experience or otherwise arising out of or in connection with the fulfillment of a purchased Experience, or (ii) are responsible for and each expressly disclaims and you release each such person or entity from any liability for any injury, damage or harm to any person or entity or to real or personal property, financial or physical loss, death, inconvenience or delay arising out of or in connection with Purchaser's purchase of or participation in any Experience or otherwise arising out of or in connection with the fulfillment of a purchased Experience.
    Without limiting the generality of the foregoing, no IfOnly Party and no Sotheby's Party will be liable for any incidental, punitive, special, exemplary or consequential damages, including lost profits, loss of data or goodwill, service interruption, computer damage or system failure or the cost of substitute services arising out of or in connection with Purchaser's purchase of or participation in any Experience or otherwise arising out of or in connection with the fulfillment of a purchased Experience, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not such person or entity has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose.
    No IfOnly Party and no Sotheby's Party assumes any responsibility for any Luminary's, Charity 's or Purchaser's failure to comply with any applicable laws and regulations. Each Sotheby's Party and each IfOnly Party explicitly disclaims and you release each Sotheby's Party and each IfOnly Party from any and all liability for any act or omission of any Luminary, Purchaser, Charity or other person or entity. Neither Sotheby's nor IfOnly can control Purchaser's or any guest's interaction with any Luminary or third party and each Sotheby's Party and IfOnly Party expressly disclaims and you release each Sotheby's Party and each IfOnly Party from any liability arising out of or in connection with such interaction.
    You agree that any legal remedy or liability that you seek to obtain arising out of or in connection with any Experience or the auction will be limited to a claim against the particular Luminary or other third parties. You agree not to impose or attempt to impose any liability on any Sotheby's Party or IfOnly Party or seek any legal remedy from any Sotheby's Party or IfOnly Party with respect to any Experiences or the auction.

    20. Assignment
    No party may assign or transfer these Conditions of Sale or any rights or obligations hereunder, by operation of law or otherwise, without Sotheby's prior written consent. Any attempt to so assign or transfer without such consent will be null and of no force or effect. Notwithstanding the foregoing, Sotheby's may freely assign or transfer these Conditions of Sale or any of its rights or obligations hereunder without restriction. Subject to this Section 20, these Conditions of Sale will bind and inure to the benefit of the parties, their successors and permitted assigns.

    21. Data Protection
    Sotheby's will use information provided by its clients (or which Sotheby's otherwise obtains from other sources relating to its clients) for the provision of auction and art-related services, loan services, client administration, marketing and otherwise to manage and operate its business, or as required by law, in accordance with Sotheby's Privacy Policy. This will include information such as the client's name and contact details, proof of identity, financial information, records of the client's transactions, and preferences. Some gathering of information about Sotheby's clients will take place using technical means to identify their preferences in order to provide a higher quality of service to them. Sotheby's may also disclose the client information to other Sotheby's Companies and/or third parties acting on their behalf to provide services for these purposes. Sotheby's will share your information with IfOnly for purposes of the fulfillment of the Experience and IfOnly will share such information with the Luminary. IfOnly and Luminary may use your information in accordance with their privacy policies and procedures.

    If the client provides Sotheby's with information that is defined by European data protection laws as "sensitive", the client agrees that it may be used for the purposes set out above.
    In the course of these disclosures, personal data collected in the European Economic Area may be disclosed to countries outside the European Economic Area. Although such countries may not have legislation that protects a client's personal information, Sotheby's shall take great care to keep such information secure and in accordance with European data protection principles. By agreeing to these Conditions of Sale, the client is agreeing to such disclosure.
    Please be aware that Sotheby's may film auctions or other activities on Sotheby's premises and that such recordings may be transmitted over the Internet via Sotheby's website, the eBay website, the Invaluable website and other Online Platforms.
    Under European data protection laws, a client may object, by request and free of charge, to the processing of their information for certain purposes, including direct marketing, and may access and rectify personal data relating to them and may obtain more information about Sotheby's data protection policies by writing to Sotheby's, 34-35 New Bond Street, London W1A 2AA, or 1334 York Avenue, New York, NY 10021, Attn: Compliance, or emailing Sotheby's use of information collected about Invaluable users may differ and is also governed by the terms of the Invaluable Privacy Policy and Sotheby's on Invaluable Online Platform Privacy Policy, which can be found on the Sotheby's on Invaluable Auction Website throughout the registration and auction period.

    22. Background checks
    IfOnly reserves the right to conduct either by itself, or through third party service providers, background checks on you as a Purchaser, including criminal background checks. IfOnly may communicate the findings of any such background check to the applicable Luminary and to Sotheby's. You agree to provide any required or applicable signed consents for you as a Purchaser, within two (2) business days from the time Sotheby's or IfOnly contacts you (unless a shorter time is required), to enable IfOnly or IfOnly's third party service providers to conduct such background checks. This information may include your date of birth and social security number. Please note that Luminary may cancel the sale following receipt of the results of any such background check.

    23. Experience Scheduling and Fulfillment;
    Cancellation Sotheby's acts as an intermediary between the Purchaser and IfOnly. IfOnly acts an intermediary between the Purchaser and the Luminary. IfOnly will assist you with the scheduling of the Experience and will act as a liaison between you and the Luminary. The Luminary, not Sotheby's and/or IfOnly, is responsible for honoring the purchase of and for actually fulfilling any Experience, subject to these Conditions of Sale.
    For Experiences that require the Purchaser and Luminary to agree on details like the time and location for the Experience, Purchaser shall have twelve (12) months from the last day of the Auction to schedule the Experience and the Purchaser must be available to participate in the Experience no later than twenty-four (24) months from the last day of the Auction. IfOnly will send both the Purchaser and Luminary confirmation emails when those details are confirmed by those parties through IfOnly. In the event that the Purchaser and the Luminary cannot come to an agreement regarding the particulars within twelve (12) months following the last day of the auction, the sale will be cancelled, IfOnly and Luminary will return any sales proceeds received to Sotheby's and then Sotheby's will credit the Purchaser the purchase price paid. For the avoidance of doubt, if the Purchaser does not make a good faith attempt to schedule the Experience as described in this paragraph the sale will not be cancelled and the Purchaser will only be entitled to a credit in the amount of the hammer price to be used on
    Once Purchaser has paid in full and IfOnly has confirmed the booking of the Experience, the Experience is neither returnable nor refundable, except:
    (i) If in Sotheby's sole judgement, the Experience has subjected or may subject Sotheby's, IfOnly or Luminary to any liability, Sotheby's may cancel the sale.
    (ii) If Luminary does not or cannot fulfill the Experience on the date initially agreed with the Purchaser at the time the booking is confirmed, and Luminary and the Purchaser cannot agree on an alternate start date that is within thirty (30) days of the originally scheduled start date or Luminary does not or cannot fulfill the Experience on the rescheduled date, Sotheby's in its sole discretion after consultation with IfOnly, may cancel the sale.
    (iii) Luminary in good faith may cancel the sale following receipt of the results of any background check.
    In the event the sale is cancelled for any of the foregoing reasons, Luminary and IfOnly will return to Sotheby's the purchase price to the extent received and following Sotheby's receipt of the purchase price from Luminary and IfOnly, Sotheby's will credit the Purchaser an amount equal to purchase price paid.
    For the avoidance of doubt, for Experiences for which there is a fixed date and time, a Purchaser will not be entitled to any refund or credit for failing to timely redeem the Experience.

    24. Link to Third Party Websites or Resources
    The Content may contain links to third-party websites or resources. Sotheby's and IfOnly provide these links only as a convenience and are not responsible for the content, products or services on or available from those websites or resources or links displayed on such third-party websites. You acknowledge responsibility for and assume all risk arising out of or in connection with your use of any third-party websites or resources.

    25. Additional Agreements
    Luminary may require any Purchaser or any guest to enter into an agreement with the Luminary. Purchaser acknowledges that if Purchaser or any guest fails to do so, Purchaser and/or such guest may not be able to participate in the Experience and Purchaser may not receive a refund or exchange for the purchase of the Experience. Purchaser and any guests may be required to sign and return a waiver and liability release before Purchaser or any guest can participate in an Experience.

    26. Conflict
    For bidders bidding through the Invaluable platform, in the event of any conflict between Invaluable's Terms and Conditions and Sotheby's Conditions of Sale, Sotheby's Conditions of Sale will control.

    27. Guests
    In order to participate in an Experience, all guests must be (21) years of age or older (unless otherwise expressly noted in the Experience Listing) and must not be barred from participation under applicable law. Guests may be required to present satisfactory legal documentation with respect to their age. In addition, all other requirements and restrictions governing Purchaser's ability to participate in an Experience also apply to all guests. By way of example, if an Experience requires that a background check be performed on the Purchaser, all guests must also undergo a background check. If the Luminary is not satisfied with the results of the background check, the guest cannot participate in the Experience. Except for purchaser information, the terms and conditions governing the protection and use of any guest information provided to IfOnly and/or any Luminary (such as name, address) shall be governed by IfOnly's and the applicable Luminary's respective policies and procedures. The protection and use of purchaser information shall be as set forth in these Conditions of Sale. Guests are not a third-party beneficiary under these Conditions of Sale.

    The following will help in understanding the auction buying process as well as some of the terms commonly used in an auction e-catalogue. All bidders should read the Conditions of Sale in this e-catalogue, as well as the Glossary, if any, or any other notices. By bidding in the auction, bidders are bound by the Conditions of Sale, as amended by notices, which together form the sale contract among Sotheby's, the seller (Luminary) of the Experience and any bidders, including the Purchaser.


    Unless indicated by a box, all lots in this catalogue are offered subject to a reserve. A reserve is the confidential minimum hammer price at which a lot will be sold. The reserve is generally set at a percentage of the low estimate and will not exceed the low estimate of the lot. If any lots in the catalogue are offered without reserve, such lots will be designated by a box. If every lot in a catalogue is offered without a reserve, the Conditions of Sale will so state and this symbol will not be used for each lot.

    Lots with this symbol are offered without reserve and will be sold to the highest bidder acknowledged by the Sotheby's and Invaluable online bidding systems who has submitted a bid equal to or in excess of $50.00.

    Interested Parties
    Lots with this symbol indicate that parties with a direct or indirect interest in the lot may be bidding on the lot, including (i) the beneficiary of an estate selling the lot, or (ii) the joint owner of a lot. If the interested party is the successful bidder, they will be required to pay the full Buyer's Premium. In certain instances, interested parties may have knowledge of the reserve.


    The E-catalogue
    The e-catalogue will be available online at the start of the auction and is available throughout the auction.

    Each lot in the e-catalogue is given a low and high estimate, indicating to a prospective buyer a range in which the lot might sell at auction. When possible, the estimate is based on previous auction records of comparable pieces. The estimates are often determined several months before a sale and are therefore subject to change upon further research of the experience, or to reflect market conditions or currency fluctuations. Estimates should not be relied upon as a representation or prediction of actual selling prices.

    Unless otherwise noted in the e-catalogue or by a notice posted on the Sotheby's and Invaluable websites, Sotheby's does not permit the seller to bid on his or her own experiences.

    If you would like to bid, you must register on the Sotheby's or Invaluable website. Sotheby's reserves the right, in its sole discretion, to refuse your registration or participation in the auction or to revoke your permission to participate before, during or after the sale. All lots sold will be invoiced to the name and address registered for the bid and cannot be transferred to other names and addresses. Sotheby's reserves the right to refuse to accept payment from a source other than the buyer of record. For information about registering to bid please visit the Sotheby's or Invaluable website.

    Employee Bidding
    Sotheby's employees may bid in a Sotheby's auction only if the employee does not know the reserve and if the employee fully complies with Sotheby's internal rules governing employee bidding.

    Hammer Price and the Buyer's Premium
    For lots which are sold, the last price for a lot noted by the Sotheby's and Invaluable online bidding systems is the hammer price. A buyer's premium will be added to the hammer price and is payable by the Purchaser as part of the purchase price. The buyer's premium will be the amount stated in these Conditions of Sale.


    If your bid is successful, your invoice will be e-mailed to you. The total purchase price is determined by adding the buyer's premium to the hammer price on a per-lot basis and sales tax, where applicable, will be charged on the hammer price and buyer's premium. Payment of the total purchase price is due in full immediately after the sale. However, under certain circumstances, Sotheby's may, in its sole discretion, offer bidders an extended payment plan. Such a payment plan may provide an economic benefit to the bidder. Credit terms should be requested at least one business day before the sale. However, there is no assurance that an extended payment plan will be offered. Please contact Post Sale Services or the specialist in charge of the sale for information on credit arrangements for a particular lot. Please note that Sotheby's will not accept payments for purchased lots from any party other than the Purchaser, unless otherwise agreed between the Purchaser and Sotheby's prior to the sale.

    Payment by Cash
    It is against Sotheby's general policy to accept single or multiple related payments in the form of cash or cash equivalents in excess of the local currency equivalent of US $10,000. It is Sotheby's policy to request any new clients or Purchasers preferring to make a cash payment to provide: verification of identity
    (by providing some form of government issued identification containing a photograph, such as a passport, identity card or driver's license), confirmation of permanent address and identification of the source of the funds.

    Payment by Credit Cards
    Sotheby's accepts payment by credit card for Visa, MasterCard, and American Express only. Credit card payments may not exceed $50,000 per sale. Payment by credit card may be made (a) online at, (b) by calling in to Post Sale Services at +1 212 606 7444, or (c) in person at Sotheby's premises.

    Payment by Check
    Sotheby's accepts personal, certified, banker's draft and cashier's checks drawn in US Dollars (made payable to Sotheby's). While personal and company checks are accepted, Experiences cannot be scheduled until such checks have cleared, unless you have a pre-arranged check acceptance agreement. Application for check clearance can be made through the Post Sale Services.

    Certified checks, banker's drafts and cashier's checks are accepted at Sotheby's discretion and provided they are issued by a reputable financial institution governed by anti-money laundering laws. Instruments not meeting these requirements will be treated as "cash equivalents" and subject to the constraints noted in the prior paragraph titled "Payment By Cash".

    Payment by Wire Transfer
    To pay for a purchase by wire transfer, please refer to the payment instructions on the invoice provided by Sotheby's or contact Post Sale Services to request instructions.

    Sales and Use Tax
    New York sales tax is charged on the hammer price, buyer's premium and any other applicable charges on any taxable services rendered in New York State, regardless of the state or country in which the Purchaser resides or does business. Please refer to "Information on Sales and Use Tax Related to Purchases at Auction" in the back of the e-catalogue.

    Once your payment of the total purchase price has been received and cleared, Sotheby's shall provide you the information necessary to redeem and schedule your experience through IfOnly.

    If you have property you wish to sell, Sotheby's team of specialists and client services representatives will assist you through the entire process. Simply contact the appropriate specialist (specialist departments are listed in the back of this e-catalogue), General Inquiries Department or a Sotheby's regional office representative for suggestions on how best to arrange for evaluation of your property.

    Property Evaluation
    There are three general ways evaluation of property can be conducted:

    (1) In Sotheby's galleries
    You may bring your property directly to Sotheby's galleries where Sotheby's specialists will give you auction estimates and advice. There is no charge for this service, but Sotheby's requests that you telephone ahead for an appointment. Inspection hours are 9:30 am to 5 pm, Monday through Friday.
    (2) By photograph
    If your property is not portable, or if you are not able to visit Sotheby's galleries, you may bring in or send a clear photograph of each item. If you have a large collection, a representative selection of photographs will do. Please be sure to include the dimensions, artist's signature or maker's mark, medium, physical condition and any other relevant information. Sotheby's specialists will provide a free preliminary auction estimate subject to a final estimate upon first-hand inspection.
    (3) In your home
    Evaluations of property can also be made in your home. The fees for such visits are based on the scope and diversity of property, with travel expenses additional. These fees may be rebated if you consign your property for sale at Sotheby's. If there is considerable property in question, Sotheby's can arrange for an informal "walkthrough."
    Once your property has been evaluated, Sotheby's representatives can then help you determine how to proceed should you wish to continue with the auction process. They will provide information regarding sellers' commission rates and other charges, auction venue, shipping and any further services you may require.

    Valuations and Appraisals
    Sotheby's Valuations and Appraisals Services offers advice regarding personal property assets to trusts, estates, and private clients in order to help fiduciaries, executors, advisors, and collectors meet their goals. Sotheby's provides efficient and confidential advice and assistance for all appraisal and auction services. Sotheby's can prepare appraisals to suit a variety of needs, including estate tax and planning, insurance, charitable contribution and collateral loan. Sotheby's appraisals are widely accepted by the Internal Revenue Service, tax and estate planning professionals, and insurance firms. In the event that a sale is considered, Sotheby's is pleased to provide auction estimates, sales proposals and marketing plans. When sales are underway, the group works closely with the appropriate specialist departments to ensure that clients' needs are met promptly and efficiently.

    Financial Services
    Sotheby's offers a wide range of financial services including advances on consignments, as well as loans secured by art collections not intended for sale.

    Museum Services
    Tailored to meet the unique needs of museums and non-profits in the marketplace, Museum Services offers personal, professional assistance and advice in areas including appraisals, deaccessions, acquisitions and special events.

    Corporate Art Services
    Devoted to servicing corporations, Sotheby's Corporate Art Services Department can prepare appraisal reports, advise on acquisitions and deaccessions, manage all aspects of consignment, assist in developing arts-management strategies and create events catering to a corporation's needs.

    To better assist Sotheby's clients, Sotheby's has prepared the following information on Sales and Use Tax related to Experiences purchased at auction.

    Why Sotheby's Collects Sales Tax
    Virtually all State Sales Tax Laws require a corporation to register with the State's Tax Authorities and collect and remit sales tax if the corporation maintains a presence within the state, such as offices. In the states that impose sales tax, Tax Laws require an auction house, with a presence in the state, to register as a sales tax collector, and remit sales tax collected to the state. New York sales tax is charged on the hammer price, buyer's premium and any other applicable charges on certain taxable services rendered in New York, regardless of the state or country in which the Purchaser resides or does business.

    Where Sotheby's Collects Sales Tax
    Sotheby's is currently registered to collect sales tax in the following states: California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Minnesota, Missouri, New Jersey, New York, Ohio, Pennsylvania, and Texas. For any taxable services received by the Purchaser in New York City, such services are subject to sales tax at the existing New York State and City rate, which is currently 8.875%.

    Services Rendered by Luminary
    If taxable services are rendered in any state in which Sotheby's is registered, Sotheby's is required by law to collect and remit the appropriate sales tax in effect in the state where the services are rendered.

    Where Sotheby's is Not Required to Collect Sales Tax
    Sotheby's is not required to collect sales tax on services rendered in states other than those listed above. If the services are rendered in a state where Sotheby's is not required to collect sales tax, it is the responsibility of the Purchaser to self-assess any sales or use tax and remit it to taxing authorities in that state, if applicable.
    Sotheby's is not required to collect sales tax for services rendered outside of the United States.

    Certain Exemptions
    Most states that impose sales taxes allow for specified exemptions to the tax. For example, a registered re-seller may purchase without incurring a tax liability, and Sotheby's is not required to collect sales tax from such re-seller. The re-seller, when re-selling the experiences, may be required to charge sales tax to its client, or the client may be required to self-assess sales or use tax upon acquiring the Experiences.

    Local Tax Advisors
    As sales tax laws vary from state to state, Sotheby's recommends that clients with questions regarding the application of sales or use taxes to services rendered in connection with the Experiences purchased at auction seek tax advice from their local tax advisors.

    Shipping Terms
    All items are sold as is with no guarantees or warranties. All sales are final. No returns accepted. Please read the description of an item and ask any questions prior to placing a bid.

    Buyers will receive one invoice which includes the sale price, buyer's premium, and shipping. Payment is due with 48 hours of the end of the auction. Preferred method of payment is PayPal.
